Telematics and Driving Behaviour Policy

This policy explains how the telematics tracking device and forward-facing dashcam fitted to your vehicle work, how your driving is monitored and scored, and what this means for your hire agreement with Rapid Vehicle Management Limited (“Rapid”). It should be read together with your Hire Agreement and our Privacy Policy.

1. What the telematics device and dashcam are

1.1 As a condition of your Hire Agreement, the vehicle you hire from us is fitted with a telematics tracking device. You must keep this device installed and in use for the full duration of your agreement.

1.2 The telematics device may include a forward-facing dashcam. This equipment:
• records information about how and where the vehicle is driven (for example speed, acceleration and braking); and
• may record video of the road ahead for safety, theft-tracking and insurance purposes.

1.3 The telematics device is owned by Rapid. You are permitted to use it only in connection with your use of the vehicle under the Hire Agreement and for the services we provide (for example theft tracking and insurance support).

2. How we use telematics and your driving score

2.1 We use data from the telematics device to:
• help protect the vehicle against theft;
• monitor how the vehicle is being driven;
• manage risk under our insurance policy (Rapid insures the vehicle while it is on hire to you);and
• support investigations after any accident, incident or complaint.

2.2 We calculate a weekly driving score out of 100 based on your driving behaviour (for example speed relative to limits, harsh braking or acceleration, cornering and similar risk indicators).

2.3 We expect you to drive safely and responsibly and to maintain a weekly driving score of at least 85 out of 100 on a consistent basis. This reflects the standard of driving we require from all customers using our vehicles for private hire and reward and social, domestic and pleasure use.

3. What happens if your driving score is low

3.1 If your weekly driving score falls below 85, we may contact you to:
• let you know your recent score;
• explain the main issues (for example regular speeding or harsh braking); and
• give you guidance on how to improve your driving.

3.2 If your scores remain below 85 over a period of time, or if your score is significantly
below our required standard, we may:
• issue formal written warnings; and
• require you to co-operate with any reasonable steps we specify (for example
reviewing driving guidance or speaking with our team).

3.3 Persistent failure to meet our required standard of driving, despite warnings, may be
treated as a breach of your Hire Agreement and can lead to us ending your agreement
and requiring you to return the vehicle, following any notices we are required to give you
under the Consumer Credit Act 1974.

3.4 In serious cases (for example extreme speeding, highly dangerous driving or an
incident that gives us serious concerns about safety), we may move directly to a final
warning and/or require the vehicle to be returned while we investigate.

4. Tampering with or damaging the telematics device

4.1 You must not, and must not allow anyone else to:
• tamper with or dismantle the telematics device;
• remove or interfere with any SIM card within the device; or
• relocate, cover, disconnect or otherwise alter the device or its operation.

4.2 The telematics device is fitted with anti-tamper alerts. If we receive an alert or
otherwise suspect tampering or interference, we may require you to attend our office (or
another agreed location) so that we can inspect, maintain and, if necessary, re-calibrate
or replace the device.

4.3 Any altering or tampering with the telematics device is treated as an event of default
under your Hire Agreement and may entitle us to terminate the agreement after we have
given you any notice required under the Consumer Credit Act 1974.

4.4 If you suspect that the telematics device is defective or not working properly, you
must tell us as soon as possible so we can investigate and, if necessary, repair or
replace it. We may also contact you if we believe there is a fault and will make
reasonable efforts to resolve it at our cost.

5. Requirement to return the vehicle on demand

5.1 If we decide to end your Hire Agreement because of:
• persistent low driving scores;
• confirmed tampering with the telematics or dashcam; or
• any other serious breach of your agreement,
we may require you to return the vehicle on demand. This reflects our preferred
approach of asking you to return the vehicle before we take any steps to recover it.

5.2 If you do not return the vehicle when lawfully required to do so, we may take further
action to recover the vehicle and our losses, as set out in your Hire Agreement.

6. How we use your data

6.1 We process personal data collected through the telematics device and dashcam in
line with data protection law and our Privacy Policy.

6.2 We may use this data and share it where necessary with:
• our group companies;
• insurers, claims handlers and advisers;
• law enforcement and regulatory bodies (where legally required); and
• other third parties who provide services to us in connection with the vehicle, your
Hire Agreement or our insurance arrangements.
